These Terms of Service ("Terms", "Agreement") constitute a legally binding contract entered into between you (either individually or on behalf of an enterprise entity, "Client") and RackUp IT Solution ("RackUp IT", "Company", "we", "us"). This Agreement governs your purchase, provisioning, access, and ongoing utilization of our cloud VPS instances, managed WordPress hosting pools, API endpoints, and technical engineering services.
1. Cloud Infrastructure & Provisioning SLA
RackUp IT delivers high-performance managed hosting backed by our 99.9% Network & Hardware Uptime Service Level Agreement (SLA):
- Resource Quotas: Managed container instances are allocated dedicated CPU shares, reserved physical RAM, and NVMe block storage quotas as specified in your active billing tier. We do not engage in undisclosed host memory oversubscription.
- Scheduled Maintenance: Essential kernel updates, security patches, and network enhancements are executed during off-peak maintenance windows with advance electronic notice provided via dashboard announcements.
- Disaster Recovery Snapshots: Automated daily backups are maintained according to plan specifications. Clients are advised to maintain independent off-site copies of mission-critical application data.
2. Acceptable Use Policy (AUP)
Our infrastructure is engineered for professional, compliant web operations. Prohibited activities that will result in immediate service suspension without refund include:
- Transmission of unsolicited commercial bulk email (SPAM) or hosting open mail relays.
- Hosting malware, phishing landers, botnet command-and-control scripts, or unauthorized vulnerability scanners.
- Cryptocurrency mining or sustained CPU throttling intended to bypass container tier limits.
- Any activity violating applicable local, national, or international cybercrime legislation.
3. Subscriptions, Renewals & Transparent Billing
All hosting subscriptions are billed in advance on recurring monthly or annual billing cycles. RackUp IT enforces a strict $0 Hidden Renewal Hike Guarantee: your renewal pricing matches your original agreed recurring rate without arbitrary markups. You may cancel recurring billing or request container decommissioning at any time directly through the Client Dashboard prior to the commencement of the subsequent billing cycle.
4. Limitation of Liability
In no event shall RackUp IT, its engineers, or affiliates be liable for indirect, incidental, special, or consequential damages resulting from lost business revenues, third-party software incompatibilities (such as unmaintained third-party WordPress plugins), or network disruptions outside our direct routing jurisdiction, exceeding the total amount paid by Client during the three (3) months preceding the incident.
